Opposition Slams Constitution (130th Amendment) Bill, Calls It ‘Draconian and Unconstitutional’

Congress MP Priyanka Gandhi on Wednesday strongly criticised the proposed Constitution (130th Amendment) Bill, 2025, which seeks to provide a framework for the removal of the Prime Minister, Chief Ministers, and Ministers if they are detained for 30 days on charges of corruption or serious offences.

Calling the Bill “draconian” and “anti-constitutional,” Priyanka alleged that it could be misused to target political opponents. “To call it an anti-corruption measure is only to pull a veil across the eyes of the people. Tomorrow, you can fabricate a case against a CM, keep them in custody for 30 days without conviction, and they cease to be CM. It is absolutely undemocratic and very unfortunate,” she told reporters.

AIMIM MP Asaduddin Owaisi echoed the criticism, warning that the legislation could turn India into a “police state.” “This Bill is unconstitutional. Who will arrest the Prime Minister? The BJP wants to make the country a police state through these laws. We will oppose them. Power is not eternal,” he said outside Parliament.

CPI(M) MP Amra Ram also raised concerns, suggesting the Bill could be arbitrarily applied against political leaders. “If this is based on a 30-day detention, then everyone will be removed. A 30-day sentence is not a big crime,” he remarked.

RJD MP Sudhakar Singh went further, alleging that the government was pushing the country towards dictatorship. “The government does not have the right to punish the Prime Minister, Chief Ministers, or Ministers. With this Bill, the nation is moving towards authoritarianism,” he said.

The Constitution (130th Amendment) Bill, 2025, will be tabled in the Lok Sabha by Union Home Minister Amit Shah. It seeks to remove a Union or State Minister if they are detained for at least 30 days over allegations of corruption or serious criminal offences.
